1. Who we are

Top1Marketing is a trading name of PSC Marketing Ltd, a company registered in England and Wales under company number 11296786, with its registered office at 282 Telfer Road, Coventry, England, CV6 3DR.

PSC Marketing Ltd is the controller of the personal data described in this policy. Our registration with the Information Commissioner’s Office (ICO) is in progress, and we will publish our registration number here once it has been issued.

For any question about this policy or your personal data, email hello@top1marketing.co.uk or write to us at the address above. We are not required to appoint a Data Protection Officer, and our director handles data protection matters directly.

2. When this policy applies

This policy covers personal data we decide how to use: data about visitors to the Website, people who contact us or book a call, our customers and their staff, and people who receive our emails.

If you received a message sent through WA Scheduler: the business that sent it is the controller of your data, and we only process it on that business’s behalf, as its processor. Please read that business’s privacy policy and contact it directly about your data or to stop receiving its messages. If you contact us instead, we will pass your request on to the right business.

Our free resources are delivered through pascaandreea.com, which is also operated by PSC Marketing Ltd and has its own privacy policy describing the sign-up forms and email tools used there.

3. Data we collect

Data you give us

  • Contact and enquiry details: your name, email address, WhatsApp or phone number, business name, the plan you are interested in and anything you write in a form, email or message.
  • Booking details: your name, email address, phone number, chosen time and any answers you give when booking a call or demo.
  • Customer and billing details: your name, business details, billing address, records of what you bought and payments made. Payments are handled by Stripe and PayPal, so we never see or store your full card details.
  • Business information for your Reels: information about your business, offer and customers that we use to write your scripts.
  • Video footage: the footage you send us, which includes your image, voice and anything else visible or audible in it, and the edited Reels we create from it.
  • WA Scheduler account data: your login details, the WhatsApp number you connect, and the groups, templates, messages and contact lists you add (see section 2 for our role with contact lists).
  • Communications: emails and WhatsApp messages between us, including support requests and feedback.

Please avoid sending us sensitive information (such as health details) unless it is genuinely needed for your Reels, and make sure anyone else who appears in your footage knows you are sharing it with us.

Data we collect automatically

  • Technical and usage data: your IP address, browser and device type, operating system, pages viewed, time spent and the website that referred you, collected through server logs and, with your consent where required, cookies (see section 6).
  • Email engagement: whether you open our emails or click links in them, where our email tools record this.

Data from others

We may receive basic details about you from a booking or payment provider when you use their service to deal with us, or from a colleague who refers you to us.

5. Marketing messages

We will only send you marketing emails if you have opted in (for example, when you request a free resource) or if you are an existing or recent customer and we are telling you about similar services of ours, in which case you were given the chance to opt out when we collected your details. Every marketing email includes an unsubscribe link, and you can also ask us to stop at any time by emailing hello@top1marketing.co.uk. Unsubscribing from marketing will leave service messages about your account or orders unaffected.

We will only contact you on WhatsApp for marketing purposes if you have given us your number and agreed to hear from us there.

Cookies are small files stored on your device when you visit a website. We use strictly necessary cookies to make the Website work and keep it secure; these do not need your consent. • A buyer or successor, if our business or part of it is sold or reorganised, in which case your data would continue to be protected in line with this policy.

An up-to-date list of our service providers is available on request.

8. International transfers

Some of our service providers are based, or store data, outside the UK, for example in the European Economic Area, the United States or India. When personal data is transferred outside the UK, we make sure it is protected by one of the safeguards the law requires, such as:

  • UK adequacy regulations, which cover the EEA and certain other countries, and US companies certified under the UK Extension to the EU-US Data Privacy Framework; or
  • the ICO’s International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses.

You can ask us for more information about the safeguards used for a particular transfer.

We use appropriate technical and organisational measures to protect personal data against loss, misuse and unauthorised access, including encrypted connections (HTTPS), access controls, strong passwords with two-factor authentication on our key accounts, and limiting access to people who need it for their work. Data sent over the internet can never be guaranteed to be completely secure, but if we become aware of a breach that is likely to put your rights at risk, we will tell you and the ICO where the law requires.

  • restriction, meaning we limit how we use your data in certain circumstances;
  • data portability, meaning you receive data you gave us in a structured, machine-readable format, or we send it to another organisation, where processing is based on consent or contract and carried out by automated means;
  • object to processing based on our legitimate interests, and to object at any time, without giving a reason, to direct marketing; and
  • withdraw your consent at any time, where we rely on consent. This does not affect processing carried out before you withdrew it.

To exercise any of these rights, email hello@top1marketing.co.uk. There is normally no charge. We may ask you to confirm your identity before acting on your request. We will respond within one month, which we can extend by up to two further months for complex or numerous requests, in which case we will tell you why within the first month.

12. Complaints

We would appreciate the chance to deal with your concerns first, so please contact us at hello@top1marketing.co.uk. You also have the right to complain to the UK’s data protection regulator:
